Am I Entitled to Bail In Maryland?
Experienced Baltimore criminal defense lawyers know that bail, and other pretrial conditions of release are to be designed to ensure:
- the accused appears at trial, and
- the safety of the victim and the community.
It is often argued that the second prong of that announced purpose is abused. These lawyers are likely aware that Maryland courts have spoken on this issue.
"We therefore hold that "preventive detention" may be ordered …. provided that the judicial officer is persuaded by clear and convincing evidence that no condition or combination of conditions of pretrial release can reasonably protect against the danger that the defendant presents to an identifiable potential victim and/or to the community.”
