COMPLIMENTARY CASE EVALUATION & LEGAL ANALYSIS
I extend a complimentary case evaluation, legal analysis and strategy planning session to anyone that is considering hiring me as their lawyer. In pre-coronavirus/COVID19 times, my preference was to conduct this initial meeting on an in-person basis. Currently, in deference to health concerns of all, I offer the conference through a variety of remote platforms, including telephonic. In this initial meeting, I have three aims:
- to explore, develop and organize the operative facts surrounding the case, claim or defense
- to identify and analyze the legal issues involved, and
- to develop a plan to achieve the client's objectives.
A fourth aim is to extend this service to the prospective client at no cost.
INQUIRY AND DEVELOPMENT OF FACTS
A thorough understanding of factual circumstances underpinning your claim or your defense is of fundamental importance in any case. If it is a personal injury matter, then how the accident leading to injury happened, the nature and extent of the injury, and the precise nature of the damage are the very fabric of the case. If it is a criminal matter, then the precise allegations against the accused and the disclosed facts- if any- that support those allegations are enormously significant. Mastery of the facts is an essential component in mounting any effective defense in a criminal case. In the initial case evaluation, I will highlight and organize for you the facts that appeal to me as relevant and salient.
LEGAL ANALYSIS AND OPINION
During our session, or at the conclusion of it, I'll offer you an initial opinion regarding to the legal theories, claims, and defenses that may become important in your case. We’ll discuss the specific mechanics of how the law applies to your factual scenario. If it is a personal injury or workers compensation claim, then we will discuss the theories of recovery - whether that is negligence, some type of intentional conduct, or otherwise. We will discuss legal theories that support a particular claim of damage. We will discuss any defenses -such as contributory negligence, assumption of the risk, and the like- that might be factors in your case.
OBJECTIVES and STRATEGY
One of my primary motives in extending this complimentary, personal process is to obtain a complete understanding of the client’s goals, objectives and aims. A necessary second step in this process, is to determine if I can help the person, and how. As part of this initial strategy session, I will outline a preliminary plan, a roadmap if you will, of how the objectives of the representation will be achieved.
