The Law of Trespass

Experienced Trespassing Defense Attorney in Baltimore, MD.

Trespassing is defined as entering the property of another without consent or legal authority.
Trespass is being where you should not be when you know you should not be there. There are two varieties of trespass punished by Maryland law. One can be convicted of trespass where there are “no trespassing” signs that are ignored or where one re-enters property after the owner tells them not to. The law requires specific types of no trespass warning signs to bring a violation within the section.

What are the Circumstances with Trespassing Charges?

Trespassing is a misdemeanor that carries a penalty of up to 90 days in jail and a fine of up to $500 for first time offenders, and a sentence of up to six months in jail and a fine of up to $1,000 if the offense is repeated within two years after the first.

Entering property that one has been warned off or staying there after a warning subjects you to a penalty for trespassing. A warning to stay off private land is good for all time, whereas a warning to leave public property is effective for only the occasion in issue.
