What Are Sex Crimes Under Maryland Law?

- two degrees of rape;
- four degrees of sex offenses;
- sodomy;
- unnatural and perverted sex act;
- incest, and
- solicitation of a minor.
The sexual offense laws also contain multiple important definitions of proscribed conduct that we will look at in detail in other guides. There are special procedural and evidentiary rules that apply in sex crime prosecutions. The stigma of accusation, let alone a conviction, of sexual offenses cannot be overlooked. Moreover, anyone convicted of a Tier 1, Tier 2 or Tier 3 sexual offense must register with the person’s supervising authority. The Criminal Procedure Article, § 11-717, Annotated Code of Maryland states that: “The Department shall post on the internet…in plain language that can be understood without special knowledge of the criminal laws of the State, a factual description of the crime of the offender that is the basis for registration, excluding details that would identify the victim.”
